4. Purpose of Processing

Refund Policy
1. General Policy
SkylineMetricSystems delivers analytics services on a project-based engagement model. Due to the bespoke nature of our work, refunds are evaluated individually based on the completion status of each project phase and the deliverables received by the client.
2. Pre-Project Cancellation
If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 14 business days. Cancellations must be submitted in writing to [email protected].
3. Mid-Project Cancellation
If a project is cancelled after work has begun, SkylineMetricSystems will issue a partial refund proportional to the remaining undelivered phases. Completed milestones and their corresponding fees are non-refundable. A detailed breakdown of completed and pending work will be provided.
4. Defective Deliverables
If a delivered analytics module fails to meet the specifications agreed upon in the project scope, SkylineMetricSystems will, at its discretion, either remediate the defect at no additional cost or issue a partial refund corresponding to the affected deliverable. Defect claims must be submitted within 30 days of delivery.
5. Refund Processing
Approved refunds are processed via the original payment method within 14 business days of approval. Transaction fees charged by payment processors are non-refundable. Clients will receive confirmation once a refund has been executed.
6. Dispute Resolution
Any disputes regarding refunds should be directed to [email protected]. SkylineMetricSystems commits to resolving refund disputes within 30 business days of initial contact. Unresolved disputes may be escalated to the relevant consumer protection authority in Madrid, Espana.
Terms of Service
1. Acceptance of Terms
By engaging the services of SkylineMetricSystems, located at C. Joaquin Fernandez de Avila 9, Pozuelo de Alarcon, Madrid, Espana, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
2. Scope of Services
SkylineMetricSystems provides analytics consulting, dashboard development, data pipeline architecture, and related intelligence services. The exact scope, deliverables, timeline, and pricing for each engagement are defined in a separate Statement of Work (SOW) agreed upon by both parties prior to commencement.
3. Payment Terms
Unless otherwise specified in the SOW, payment terms are as follows:
- A 40% advance payment is required before project initiation.
- 30% is due upon delivery of the first milestone.
- The remaining 30% is due upon final delivery and acceptance of all deliverables.
- All invoices are payable within 14 business days of issuance.
- Late payments incur a penalty of 2% per month on the outstanding balance.
4. Intellectual Property
Upon full payment, all deliverables produced under the SOW are transferred to the client, including custom dashboards, data models, and configuration files. SkylineMetricSystems retains ownership of its proprietary methodologies, frameworks, libraries, and internal tools used in service delivery. Pre-existing intellectual property remains with its respective owner.
5. Confidentiality
Both parties agree to maintain strict confidentiality regarding all proprietary information exchanged during the engagement. This includes business data, technical architectures, financial figures, and strategic plans. Confidentiality obligations survive the termination of the engagement for a period of 36 months.
6. Limitation of Liability
SkylineMetricSystems shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability under any engagement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We do not guarantee specific business outcomes from analytics implementations.
7. Data Protection
All processing of personal data in connection with our services is governed by the Privacy Policy of SkylineMetricSystems and complies with the EU General Data Protection Regulation (GDPR). Clients are responsible for ensuring they have the legal basis to share any personal data with us for processing.
8. Termination
Either party may terminate the engagement with 30 days written notice. In the event of termination, the client shall pay for all work completed up to the termination date. SkylineMetricSystems shall deliver all completed deliverables and provide reasonable transition support for a period of 14 days post-termination.
9. Governing Law
These Terms of Service are governed by the laws of Spain. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Espana.
10. Amendments
SkylineMetricSystems reserves the right to amend these Terms of Service at any time. Material changes will be communicated via email to active clients at least 15 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the amended terms.
